Making a Will is an important step that every person should take. It is more important again if you have children. You will want to be certain that your wishes are clearly stated, and to ensure that your instructions can be followed.
Under current tax law, all gifts and inheritances are liable to Capital Acquisitions Tax (CAT) otherwise known as Inheritance Tax. The amount of tax payable is dependent upon the relationship between the donor (in the case of a will the testator) and the beneficiary, and whether the beneficiary has received previous gifts or inheritances from the same class of relative. There are differing tax-free thresholds between different classes of relatives, and it is the excess over this threshold which becomes liable to tax by the beneficiary. The tax on this excess can be significant, and in some instances can lead to the unplanned sale of the family home to meet that tax liability. For that reason it is extremely important that, in making a will, you attempt to minimise the tax payable by your loved ones. This is called ‘estate planning’.
