Work Injury - Employers Liability
Every employer must meet minimum health and safety standards to prevent their employees being involved in a work accident. These minimum standards include:

  • A safe building or place in which to work
  • A safe way for you to carry out your work
  • A safe system of work with proper training and supervision
  • Suitable materials and equipment
  • Where necessary suitable protective clothing
  • Capable staff
The legal duty of an employer is to minimise the risk of accidents at work by taking reasonable care for the health and safety of an employee. Even if your injury was caused by something a fellow worker did, or didn't do, or by the failure of equipment supplied by someone other than your employer your employer will still usually be liable. Financial losses caused as a result of an accident at work can also be claimed including:

  • Loss of earnings
  • Special care aids
  • Prescription charges and medical fees
  • Cost of care and assistance
  • Adapted accommodation
  • Costs of assistance for household chores
The claim for injury in the workplace must be referred in the first instance to the Personal Injuries Assessment Board (PIAB), but, as in the case of other types of personal injury, you should always consult a solicitor before making any such claim. We can guide you through this process, and can also advise you on the sufficiency or otherwise of any award which PIAB might make. If you are unhappy with such an award, you have the right to bring the matter to court, and in such an instance you need the professional advice of a solicitor experienced in the value, or quantum, of different types of claims.
